FULL TERMS OF USE

These terms came into effect in Ontario, Canada on March 28, 2020.

Who we are

Our website address is: http://www.parentalmental.com

Our objective is to create an honest forum for parents and caregivers to share their experiences and feelings while navigating our own mental health challenges, including mental illness.

In order to achieve our goal of honest discussion, we have implemented anonymous posting, where users are not required to add personally identifiable information, such as your name or email address, in order to ask a question or provide an answer.

We strive to provide peace of mind, comfort and a sense of trust for those using our forum.

Parental Mental does not provide medical advice and is intended for informational purposes only. It is not a substitute for professional medical advice, diagnosis or treatment.
If you think you may have a medical emergency, please contact your health professional.

These Terms of Use are subject to change at any time. 

PRIVACY

What personal data we collect and why we collect it

Posting/Sharing 

When visitors post to the site we collect the content typed into the form. An IP address is recorded for each post/reply/comment. These are not accessible to the public.

Cookies

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you post something, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just posted.

Embedded content from other websites

Questions and answers on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Parental Mental may contain links to third-party websites, products, or services, which may be posted by advertisers, our affiliates, our partners, or other users (“Third-Party Content”). Third-Party Content is not under our control, and we are not responsible for any of their websites, products, or services.
Your use of Third-Party Content is at your own risk and you should make any investigation you feel necessary before proceeding with any transaction in connection with such Third-Party Content.
Parental Mental may also contain sponsored Third-Party Content or advertisements. The type, degree, and targeting of advertisements are subject to change, and you acknowledge and agree that we may place advertisements in connection with the display of any Content or information on Parental Mental, including Your Content.

Content

Parental Mental may contain information, text, links, graphics, photos, videos, or other materials (“Content”), including Content created with or submitted to Parental Mental by you (“Your Content“).

We take no responsibility for and we do not expressly or implicitly endorse any of Your Content.

By submitting Your Content to Parental Mental, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms of Use.

The following content is NOT ACCEPTABLE:

+ Pornographic in nature,
+ Any inappropriate content alluding to minors,
+ Inappropriate sexual content (talking about sex among consenting adults is acceptable),
+ Encourages or incites violence (discussing thoughts of violence is acceptable within reasonable limits),
+ Threatens, harasses or defames a person, culture, belief, lifestyle, etc., and/or encourages others to do so,
+ Presents personal and confidential information about the poster or someone else (doxing),
+ Impersonates an individual or entity in a misleading or deceptive manner,
+ Uses Parental Mental or its affiliate sites to solicit or facilitate any transaction or gift involving certain goods and services,
+ Is considered spam,
+ It offends basic human decency. 
 
Because you alone are responsible for Your Content, you may expose yourself to liability if you post or share Content without all necessary rights.

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included.

Visitors to the website can download and extract any location data from images on the website.

You retain any ownership rights you have in Your Content, but you grant Parental Mental the following license to use that Content:

When Your Content is created with or submitted to Parental Mental, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works from, distribute, perform, and display Your Content and any name, username, voice, or likeness provided in connection with Your Content in all media formats and channels now known or later developed.

You also agree that we may modify or remove information or metadata associated with Your Content that violates our Terms of Use, and you irrevocably waive any claims and assertions of moral rights or attribution with respect to Your Content.

Any ideas, suggestions, and feedback about Parental Mental that you provide to us are entirely voluntary, and you agree that Parental Mental may use such ideas, suggestions, and feedback without compensation or obligation to you.

Although we have no obligation to screen, edit, or monitor Your Content, we may, in our sole discretion, delete or remove Your Content at any time and for any reason, including for a violation of these Terms of Use, a violation of our Content policy, or if you otherwise create liability for Parental Mental or their affiliated companies and organizations.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

We are obliged to keep data for administrative, legal, or security purposes and, must hand over that information should the law require us to do so.

Where we send your data

Visitor comments are checked through an automated spam detection service (Akismet). Cookies are used by WP Terms Popup to identify repeat users’ IP address in order to administer the Terms of Use popup.
We use Google reCAPTCHA V2 to protect our site from spam. 
We use Jetpack in our WordPress installation to view our site stats. 

Indemnity

Except to the extent prohibited by law, you agree to defend, indemnify, and hold us, our licensors, our third party service providers and our officers, employees, licensors, and agents harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of (a) your use of Parental Mental, (b) your violation of these Terms of Use, (c) your violation of applicable laws or regulations, or (d) Your Content. We reserve the right to control the defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

PARENTAL MENTAL DOES NOT PROVIDE MEDICAL ADVICE, AND IS INTENDED FOR INFORMATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT. WE ENCOURAGE ANYONE THAT FEELS AS THOUGH THEY ARE IN NEED OF HELP, TO CONTACT THEIR MEDICAL PROFESSIONAL, LOCAL HOSPITAL OR EMERGENCY SERVICE IMMEDIATELY.

THE ENTITIES DO NOT CONTROL, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY CONTENT AVAILABLE ON OR LINKED TO THE SERVICES OR THE ACTIONS OF ANY THIRD PARTY OR USER, INCLUDING MODERATORS. Limitation of Liability

IN NO EVENT AND UNDER NO THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE, WILL THE ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES, INCLUDING THOSE ARISING FROM OR RELATING TO CONTENT MADE AVAILABLE ON THE SERVICES THAT IS ALLEGED TO BE DEFAMATORY, OFFENSIVE, OR ILLEGAL. ACCESS TO, AND USE OF, THE SERVICES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM. Any claims arising out of or relating to these Terms of Use will be governed by the laws of Ontario, Canada, other than its conflict of laws rules; all disputes related to these Terms of Use will be brought solely in the federal or provincial courts located in Toronto, Ontario; and you consent to personal jurisdiction in these courts.
